General Terms and Conditions
1. VALIDITY OF THE GENERAL TERMS AND CONDITIONS / CONCLUSION OF CONTRACT
These GTC apply to purchase contracts with private individuals and companies.
The order is confirmed by the supplier.
2. PRICES AND SPECIAL OFFERS
Prices are quoted in CHF - VAT is included in the prices - prices are subject to change.
Shipping costs: PostPac Economy: 9.- CHF.
PostPac Priority: 13.- CHF.
Bulky goods: 32.- CHF.
Freight forwarding delivery: actual freight costs
3. DELIVERY CONDITIONS
Delivery normally takes place within 7 working days. If this delivery time cannot be met, the customer will be informed. If this does not happen, the customer is entitled to waive the delivery.
4. RIGHT OF WITHDRAWAL
The buyer can return goods from our standard range that are as good as new to us within 14 days without giving reasons. Custom-made products and goods ordered especially for the customer cannot be returned. If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract.The deadline is met if you send the goods before the period of fourteen days has expired.You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
5. COMPLAINTS
Damage must be claimed upon delivery and reported to us within 7 days.
6. PAYMENT
Payment is possible via PayPal, card payment, prepayment, invoice or Twint. We ask new customers to pay in advance when placing their first order. We deliver to customers known to us against invoice. If you pay in advance, we will give you our bank details in the order confirmation or you can pay the amount by Twint. If you pay by invoice, this will be enclosed with the goods. The payment period is 30 days, no discount is granted.
We do not accept cash discounts. After the payment period of 30 days has expired, the customer will be sent a reminder. If the customer does not pay, debt collection proceedings will be initiated after a certain period.
7. RETENTION OF TITLE
The goods remain the property of Thomas Wampfler TW Saegewerke until full payment has been received.
8. DATA PROTECTION AND SECURITY OF ONLINE CONNECTIONS
Thomas Wampfler TW Sägewerke undertakes to ensure state-of-the-art security for hardware and software over which it has influence and to comply with the rules of data protection.
9. PLACE OF JURISDICTION
Swiss law shall apply to these GTCs, in particular the provisions of the Swiss Code of Obligations.
The place of jurisdiction for both parties is the registered office of Thomas Wampfler TW Sägewerke.
10 MISCELLANEOUS
These GTC's are valid from 01.10.2023 and replace all previous delivery and business conditions of older date.
11. GUARANTEE / WARRANTY
The warranty period is 2 years for deliveries to consumers and 1 year for goods used for commercial purposes. Within these periods, we will remedy all defects subject to the statutory warranty free of charge. Your claims for defects are initially limited to subsequent performance (repair or replacement delivery) of defect-free goods. If the subsequent performance fails, you may, at your discretion, withdraw from the purchase contract or demand a reduction in the purchase price. Excluded from the warranty or guarantee are damages caused by natural wear and tear, improper use and lack of or incorrect care.
Irrespective of all legal regulations, we will always endeavor to settle any damage in an accommodating manner.
